Terms & Conditions of Hire

Summary of Key Terms
1. Definitions
'Company' means Treorchy Tool Hire Ltd. 'Customer' means the person, firm, company or organisation hiring Equipment from us. 'Equipment' means all tools, plant, accessories, attachments, consumables, leads, chargers, transformers and related items supplied under a hire. 'Hire Agreement' means the document, order, delivery note or digital confirmation for a specific hire. 'Hire Period' runs from collection or delivery until the Equipment is returned to and accepted by us.
2. Basis of contract
These Terms apply to every hire unless agreed otherwise in writing. Each Hire Agreement incorporates these Terms. All Equipment remains the property of Treorchy Tool Hire Ltd.
3. Hire period & charges
Hire charges apply for the full duration of the Hire Period, including weekends and public holidays, unless otherwise agreed in writing. Charges accrue until the Equipment is returned to us in good working order.
4. Payment
All hire charges must be paid in full at the commencement of the Hire Period unless a credit account has been previously approved. Late payments may incur interest above the Bank of England base rate from the due date until payment is received.
5. Use of equipment
Equipment must be used only for the purpose for which it was designed. The Customer must not modify or attempt to repair Equipment without prior written consent, and must ensure all operators are appropriately trained and qualified.
6. Maintenance & breakdowns
The Customer must keep Equipment in good repair and condition and notify us immediately of any breakdown. We will use reasonable efforts to repair or replace Equipment, but are not liable for loss or damage arising from a breakdown or delay in repair.
7. Loss or damage
The Customer is responsible for the risk of loss or damage to Equipment from delivery until return, and must insure it for full replacement value. Any damage or loss will be charged at full replacement or repair cost, including loss of hire during the repair period.
8. Termination
We may terminate the hire immediately if the Customer breaches any of these terms. Upon termination the Equipment must be returned immediately; if not, we may enter the Customer's premises to repossess it.
9. Limitation of liability
Our liability for any claim arising out of the hire is limited to the total hire charges paid by the Customer. We are not liable for any indirect or consequential loss, including loss of profit or business interruption.
